General Terms and Conditions

1. SCOPE

The following General Terms and Conditions apply to all orders placed via our online shop by consumers and businesses.

For Germany: According to Section 13 of the German Civil Code (BGB), a consumer is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity.

For Austria: In the following terms and conditions, "consumer" is understood to mean "consumer" within the meaning of the Consumer Protection Act (KSchG).

For Switzerland: In the following terms and conditions, "consumer" is understood to mean "consumer" under Swiss law.

Businesses are all natural and legal persons who are not consumers.

For businesses: If the business uses conflicting or supplementary general terms and conditions, their validity is hereby rejected; they will only become part of the contract if we have expressly agreed to them.

2. CONTRACTUAL PARTNER, CONCLUSION OF CONTRACT, CORRECTION OPTIONS

The purchase contract is concluded with Heinrich Glaeser Nachf. GmbH.

The presentation of the products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalog. You can initially place our products in your shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained in the ordering process. By clicking the order button, you submit a binding offer for the goods contained in the shopping cart. Confirmation of receipt of your order will be sent by email immediately after you submit the order.

We accept your offer within two days by:

* submitting a declaration of acceptance in a separate email, or
* having the goods delivered, or
* if applicable, the payment transaction is carried out by our service provider or the selected payment service provider. The time of execution of the payment transaction depends on the selected payment method (see "Payment").

The relevant alternative depends on which of the listed events occurs first.

4. DELIVERY CONDITIONS

Shipping costs will be added to the stated product prices. You can find out more about shipping costs in the offers.

We only ship by mail. Unfortunately, picking up the goods yourself is not possible.

5. PAYMENT

The following payment methods are generally available in our shop:

Prepayment
If you select prepayment as your payment method, we will provide you with our bank details in a separate email and deliver the goods after receipt of payment.

Credit Card
When you place your order, you provide your credit card details. Your card will be charged immediately after placing the order.

PayPal
To pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, authenticate yourself with your login details, and confirm the payment order. The payment transaction will be processed by PayPal immediately after you place your order. Further information will be provided during the ordering process.

Sofort by Klarna
To pay the invoice amount via the payment service provider Sofort GmbH, Theresienhöhe 12, 80339 Munich, you must have a bank account activated for online banking, authenticate yourself accordingly, and confirm the payment order. Your account will be debited immediately after you place your order. Further information will be provided during the ordering process.

Apple Pay
To pay the invoice amount via the payment service provider Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA ("Apple"), you must use the Safari browser, be registered with Apple, have activated the Apple Pay feature, authenticate yourself with your login details, and confirm the payment order. The payment transaction will be processed immediately after placing the order. Further information will be provided during the ordering process.

Amazon Pay
To pay the invoice amount via the payment service provider Amazon Payments Europe S.C.A., 38 Avenue J.F. Kennedy, L-1855 Luxembourg ("Amazon"), you must be registered with Amazon, authenticate yourself with your login details, and confirm the payment order. Klarna
In cooperation with the payment service provider Klarna Bank AB (publ.), Sveavägen 46, 111 34 Stockholm, Sweden ("Klarna"), we offer you the following payment options. Payment via Klarna is only available to consumers. Unless otherwise stated below, payment via Klarna requires a successful address and credit check and is made directly to Klarna. Purchase on account via Klarna
The invoice amount is due 14 days after the goods are shipped and the invoice is received.
Would you like to shop today and pay in two months? It's that simple: Select the "Pay in two months" option when completing your order. The purchase price is due no earlier than two months after the purchase. We will send you an invoice with the payment due date.

Fees apply:

- €0.29 for orders between €10.00 and €13.99

- €0.39 for orders between €14.00 and €19.99

- €0.59 for orders between €20.00 and €24.99

- €0.69 for orders between €25.00 and €29.99

- €0.79 for orders between €30.00 and €34.99

- €0.99 for orders between €35.00 and €49.99

- €1.39 for orders between €50.00 and €69.99

- €1.59 for orders between €70.00 and €109.99 €

- €2.99 for orders between €110.00 and €159.99

- €3.99 for orders between €160.00 and €199.99

To take advantage of this offer, please place an order for at least €10.00 but no more than €199.99.

The total loan amount and the effective annual interest rate when repaying the entire amount after 3 months are: for a purchase of €10: €10.29 or 11.76%, for a purchase of €14: €14.39 or 11.30%, for a purchase of €20: €20.59 or 11.96%, for a purchase of €25: €25.69 or 11.19%, for a purchase of €30: €30.79 or 10.68%, for a purchase of €35: €35.99 or 11.47%, for a purchase of €50: €51.39 or 11.27%, for a purchase of €70: €71.59 or 9.21%, for a purchase of €110: €112.99 or 11.96%. 11.02%, and for a purchase of €160, €163.99 or 10.11%. The effective annual interest rate can be lower or higher and depends on the amount of credit granted by Klarna and the term.

Pay in 2 months is a promotional condition of Klarna's installment plan. If you do not pay your purchase in full by the specified date, the terms for flexible installments automatically apply. You then pay for your purchase conveniently in monthly installments.

If your purchase exceeds €199.99 for the first time, a valid "Buy now. Pay in 2 months" agreement only exists once you have signed an installment plan. The installment plan will be sent to you by Klarna. You can sign the contract and thus convert your purchase into an installment plan, or pay the entire purchase price by the specified due date. The due date for this payment is 14 days from the date of shipment of the goods, tickets, or, in the case of other services, the date the services or digital content become available. If you are in default of payment, Klarna may demand compensation for the resulting damages in the amount of €1.20 for each reminder. You are entitled to prove that Klarna has suffered no or only less damage.

Instalment Purchase via Klarna
You can pay the invoice amount in monthly installments of at least 1/24 of the total amount. The minimum installment is €6.95.

You always receive the goods before you have paid.
Pay a minimum of €6.95 per month or 1/24 of the total amount.
You don't need to provide a credit card number or bank details.
All your purchases are collected on one monthly statement.
Shop now - pay at the end of next month.
Monthly installment fee of €0.45, regardless of the number of purchases.
You can also pay the total amount at any time and end the installment purchase.

For a purchase of €500 under the basic installment purchase terms, the setup fee is €0. The applicable interest rate is 11.95%, which, with a monthly installment fee of €0.45, corresponds to an effective annual interest rate of 14.79%. The total amount is €538.35. With 12 installments, each installment is €44.86. This example assumes repayment within one year. The effective annual interest rate can be lower or higher and depends on the amount of credit granted to you by Klarna. The monthly payment is due upon receipt of the monthly invoice.

6. RIGHT OF WITHDRAWAL

Consumers have a right of withdrawal as described in the cancellation policy. Businesses are not granted a voluntary right of withdrawal.

7. PROPERTY OWNERSHIP ACT RETENTION OF TITLE

The goods remain our property until full payment has been made. For customers based in Switzerland, we are entitled to make a corresponding entry in the retention of title register.
The following applies additionally to entrepreneurs: We retain title to the goods until all claims arising from an ongoing business relationship have been settled in full. You may resell the reserved goods in the ordinary course of business; you assign to us in advance all claims arising from this resale – regardless of whether the reserved goods are combined or mixed with a new item – in the amount of the invoice amount, and we accept this assignment. You remain authorized to collect the claims; however, we may also collect claims ourselves if you fail to meet your payment obligations. We will release the securities to which we are entitled at your request to the extent that the realizable value of the securities exceeds the value of the outstanding claims by more than 10%.

8. TRANSPORT DAMAGES

The following applies to consumers: If goods are delivered with obvious transport damage, please report such defects to the delivery person as soon as possible and contact us immediately. Failure to file a complaint or contact us will have no consequences for your statutory rights and their enforcement, in particular your warranty rights. However, you will help us assert our own claims against the freight carrier or transport insurance.

The following applies to businesses: The risk of accidental loss and accidental deterioration passes to you as soon as we have delivered the item to the freight forwarder, carrier, or other person or institution designated to carry out the shipment.

9. WARRANTY AND GUARANTEES

9.1 LIABILITY FOR DEFECTS

The following applies to consumers based in Germany and Austria:

The following applies to consumers domiciled in Switzerland:
You should, as soon as reasonably practicable in the normal course of business, inspect the condition of the item received and, if defects for which the seller is liable are discovered, notify the seller immediately. If the consumer fails to do so, the purchased item shall be deemed approved, unless the defects were not apparent during the usual inspection. If such defects emerge later, notification must be made immediately upon discovery; otherwise, the item shall be deemed approved even with regard to these defects.

Return the defective product to us with a description of the defect. You will bear the resulting transport costs. We fulfill our warranty by remedying defects. This will be done, at our discretion, either by eliminating the defect (repair) or by delivering a defect-free item (replacement). If subsequent performance fails, you are entitled to withdraw from the contract. This does not apply to minor defects. A right to a price reduction is excluded.

The following applies to businesses and merchants:
Unless expressly agreed otherwise below, the statutory liability for defects applies.
The following limitations and shortened time limits do not apply to claims based on damages caused by us, our legal representatives, or vicarious agents.

• In the event of injury to life, body, or health.
• In the event of intentional or grossly negligent breach of duty and fraud.
• In the event of breach of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on whose compliance the contractual partner may regularly rely (cardinal obligations).
• Within the scope of a guarantee promise, if agreed, or
• To the extent that the scope of application of the Product Liability Act is open.

Limitations for Business Owners

With businesses, only our own information and the manufacturer's product descriptions included in the contract shall be deemed to constitute an agreement regarding the quality of the goods. We assume no liability for public statements by the manufacturer or other advertising statements. For businesses, the limitation period for claims for defects in newly manufactured items is one year from the transfer of risk. The sale of used goods is subject to the exclusion of any warranty. The statutory limitation periods for recourse claims pursuant to Section 445a of the German Civil Code (BGB) remain unaffected.

Regulations for Merchants

Merchants are subject to the obligation to inspect and notify defects stipulated in Section 377 of the German Commercial Code (HGB). If you fail to provide the notification stipulated therein, the goods shall be deemed approved, unless the defect was not detectable upon inspection. This shall not apply if we have fraudulently concealed a defect.

9.2 WARRANTIES AND CUSTOMER SERVICE

10. LIABILITY

We are always liable without limitation for claims based on damages caused by us, our legal representatives, or vicarious agents:

* in the event of injury to life, limb, or health,
* in the event of intentional or grossly negligent breach of duty,
* in the event of a warranty promise, if agreed, or
* insofar as the Product Liability Act applies.

In the event of a breach of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on whose compliance the contractual partner may regularly rely (cardinal obligations), due to slight negligence on our part, our legal representatives, or our vicarious agents, liability shall be limited to the damage foreseeable at the time the contract was concluded, the occurrence of which must typically be expected.

Otherwise, claims for damages are excluded.

12. DISPUTE RESOLUTION

The European Commission provides a platform for online dispute resolution (ODR), which you can find here [https://ec.europa.eu/consumers/odr/]. We are willing to participate in an out-of-court arbitration procedure before a consumer arbitration board.

13. FINAL PROVISIONS

If you are an entrepreneur, German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

If you are a merchant within the meaning of the German Commercial Code (HGB), a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between you and us is our registered office.
